My name is Steve Bis and I’ve been helping those that are in arrears with their credit cards for a long time and understand the effect it has on their lives. When you have credit card debt and believe that this matter is no longer in your hands, you need to make a choice on what to do and make it as soon as possible. You don’t want to wait until it is too late. As plenty of you must already know is that the creditors are not very easy to deal with when you call them with problems with billing. It’s pretty fascinating the way it works because when you first obtain the card they are very polite people while you are on the phone. Then if you call them to dispute a past due or over limit penalty fee and try to have it reversed enough to try and maintain payments with 8% or even the 7.9 % interest that they are charging on your credit cards. How are you suppose to come up with the money for the elevated payments now? It was bad enough to manage before the interest was raised. This is exactly why U.S. citizens are searching for other options such as credit card debt settlement vs. credit counseling, or bankruptcy. If you are not familiar with any of your options then I will give you a little information on them.

Consumer Bankruptcy

Up until late 2004 bankruptcy was to be used for people who were experiencing serious monetary troubles. Regrettably it was misused by thousands of Americans who were trying to avoid paying their credit card debts. They did not want to take responsibility for their actions. The credit card industry was sick and tired of this so they pushed to have the legislation changed. It is now known as the Bankruptcy Abuse Prevention and Consumer Protection act of 2005. It would make it much more of a task for the majority of debtors to file for chapter 7 bankruptcy. Bankruptcy should only be exercised as your very last choice after you have considered every alternative method. Also you should think of the negative aftereffects that will come back later on down the road. You would have to locate an attorney, go to court and that would cost you a lot of your hard earned income. There is also the matter of it being on your credit report anywhere from 7 to 10 years. When you are signing any important application or document you by law have to say yes when inquired about your previous bankruptcy, so this does have a long lasting effect on your ability to obtain future credit.

A credit counseling company will try to get the creditors to reduce the APR on your credit cards. This is because joining this kind of program you will still be paying back what you owe plus some of the interest for around 4 to 7 years. They will also raise your interest back up and the creditors could keep you off for at least one year and perhaps even longer. This could put you right back to where you started from, if not in a tougher situation.

This is the debt relief method which can save you the greatest amount of money. A honest debt settlement company will save you at least 40% of what you actually owe. The 40% should include all of their charges. Just like credit counseling, you will hear a lot of TV and radio advertisements quite often. These companies are opening up all across America. Some of these companies try to make it appear like they have a magical wand and are going to make all your debt disappear out of nowhere.

There are even some companies that try to use religion to gain the trust of debtors. Whatever organization you are talking to it is your responsibility to due diligence on them. You should begin with the BBB (Better Business bureau). You will be able to find out quite a bit about a company from the BBB. If you find out that a company has only been in business for a short time and has a lot of complaints against them, then you know to stay away. One more thing to keep an eye out for is how much time has the company been around. Some companies only last a couple of years before they get terminated or get caught with their hands in the cookie jar. Then some of them only stick around to earn as much as possible and close down just to open up across townusing a different name.
